LAW ON AMENDMENTS TO THE
LAW ON PUBLIC PROPERTY IN BRCKO DISTRICT OF BOSNIA AND HERZEGOVINA
Article 1
Article 8, Paragraph (1) of the Law on Public Property in Brcko District of Bosnia and Herzegovina (“Official Gazette of Brcko District of BiH”, No.28/06), shall be amended to read:
“(1) The Brcko District Mayor shall dispose of the District property through a decision on public property disposal, in accordance with the provisions of this Law unless otherwise specified by a separate law”.
After Paragraph (1) of this Article, new Paragraphs (2), (3), (4) and (5) shall be added, reading as follows:
“(2) The Mayor may authorize the Deputy Mayor to issue decisions referred to in Paragraph (1) of this Article.
(3) The Mayor shall enact the decision referred to in Paragraph (1) of this Article based on proposal of the Public Property Office Director within 15 days from the day of delivering the proposal.
(4) The Mayor may refuse to enact decision on public property disposal only if he/she issues a decision in writing within the deadline referred to in Paragraph (3) of this Article, setting out that the public property disposal cannot be done for reasons prescribed by legislation”.
(5) If, within the prescribed deadline, the Mayor fails to issue a decision referred to in Paragraph (3) or (4) of this Article, the decision on public property disposal shall be enacted by the Public Property Office Director”.
Current Paragraphs (2), (3), (4), (5) and (6) shall become Paragraphs (6), (7), (8), (9) and (10).
Article 2
In Article 12, Paragraph (1), Item e), words “District Tax Administration” shall be replaced with words “District Finance Directorate (hereinafter: the Finance Directorate”.
In Item g), Lines 1) and 2), words “Tax Administration” shall be replaced with words “Finance Directorate”.
Article 3
In Article 28, Paragraph (1), Item c), and Article 31, Paragraph (2), words “District Tax Administration”, in various cases, shall be replaced with words “District Finance Directorate”.
Article 4
This Law shall become effective eight days after being published in the “Official Gazette of Brcko District of BiH”.
