Dear Sirs, Madam:
It has been brought to my attention that the Brcko District Law on Public Companies stipulates that only the Acting Director shall represent the Public Company in the procedure of Public Company registration with the competent court (Article 26 of the Law).
This does not allow for registration by the Director in cases in which a Director is already selected and appointed.
Therefore, I am hereby amending Article 26 of the Law on Public Companies in Brcko District of Bosnia and Herzegovina (the “Official Gazette of Brcko District of Bosnia and Herzegovina” no: 15/06) and the Law on Amendments to the Law on Public Companies in Brcko District of BiH (“Official Gazette of Brcko District of BiH, No. 19/07) in the way that after Paragraph 2 of Article 26, a new Paragraph shall be added to read as follows:
“(3) The Director shall represent the Public Company in the procedure of Public Company registration with the competent court if he/she is already appointed or from the moment he/she is appointed”.
This letter has the legal effect of amending the Law on Public Companies in Brcko District of Bosnia and Herzegovina. You should arrange for this letter to be promptly published in the Official Gazette of Brcko District of Bosnia and Herzegovina.
