In accordance with the powers vested in me in Paragraphs 8, 10, 11, 13, 37, 43 of the Brcko Final Award of March 5, 1999, passed by the Arbitral Tribunal for Dispute over Inter-Entity Boundary in Brcko area;
Emphasizing that the right to property and its protection is of the highest importance for the Brcko District and its citizens;
Recognizing that theverification of old foreign currency savings is a countrywide process in the best interest of Brcko District citizens and that there should not be any obstacles in this process;
Determined to protect both public and private property and to uphold the rule of law upon which the Brcko District is based;
Regretting that the Brcko District Assembly, at its session on August 1, 2005, did not approve funds for verification of old foreign currency savings and did not award a contract to the agency, which should perform the aforementioned work;
Further regretting that a date for the next Assembly session is not known at this time;
Recognizing that there is a general agreement that Agencija za posrednicke, informaticke i finansijske usluge A.D. Banja Luka is best suited, having the relevant databases and Brcko branch office, to carry out this task;
I hereby order that:
- Verification of old foreign currency savings within Brcko District of Bosnia and Herzegovina shall be performed by the Agencija za posrednicke, informaticke i finansijske usluge A.D. Banja Luka
- The Brcko District Government is authorized to sign the contract with Agencija za posrednicke, informaticke i finansijske usluge A.D. Banja Luka without Assembly approval, providing that the cost per verification is not higher than in Republika Srpska and the BiH Federation.
- This Supervisory Order has immediate effect and shall be published without delay in the Official Gazette of the Brcko District of BiH. The Government shall undertake all necessary measures to ensure its implementation.
